Succession—executors and administrators—duties to court
When an executor of the will of personalty of a late resident of the Bailiwick swears his oath of office before the Dean or his delegate at the Ecclesiastical Court, he promises to produce a true and proper account of his administration if required to do so. In enforcing compliance with the oath by an Alderney executor, the first issue is to establish the appropriate forum for the proceedings: whilst the action lies under the Royal Court’s inherent jurisdiction, it may also be heard in the Court of Alderney. If the defendant makes no challenge to the plaintiff’s choice of jurisdiction and leave to proceed has been obtained from the court in that jurisdiction, he is deemed to have submitted to that court’s jurisdiction.
