TRUFFITT v. LAW OFFICERS OF THE CROWN
COURT OF APPEAL (Sumption, Steel and McNeill, JJ.A.): September 25th, 2007
Criminal Law—grievous bodily harm with intent—sentence
  A vicious and unprovoked attack by two youths on a total stranger at night, causing serious injury—head and torso wounds from kicking, a dislocated shoulder and the partial detachment of an ear resulting in permanent deformation despite surgery—justifies a starting point for sentencing purposes of at least 6 years’ custody. A sentence of 4½ years on a 19-year-old offender with a personal culture of violence and a criminal record, who pleads guilty and expresses contrition, is therefore not excessive. Aggressive young men who attack innocent members of the public must expect to receive long custodial sentences.
