IN THE MATTER OF JUBILEE ABSOLUTE RETURN FUND PCC LIMITED
ROYAL COURT (Collas, Deputy Bailiff): February 10th, 2006
Companies—protected cell companies—migration of foreign company
Under the Protected Cell Companies Ordinance 1997, s.8 and the Migration of Companies Ordinance 1997, s.5, the Guernsey Financial Services Commission may consent in advance to the conversion of a foreign company into a Guernsey protected cell company once it migrates to Guernsey. It may be especially appropriate to give such consent to a company incorporated abroad under legislation similar in nature to the Protected Cell Companies Ordinance and established in accordance with its broad requirements. Having obtained the necessary consents, the company may then apply to the Royal Court to be registered as a Guernsey protected cell company.
