MAGLOIRE (trading as FIRST CALL RECRUITMENT) v. WRIGHT, GOGUELIN and LEAPFROG LIMITED
ROYAL COURT (Hancox, Lieut. Bailiff): July 22nd, 2005
Employment—duties of employee—faithful service
In contracts of employment, there is an implied term that the employee will render honest and faithful service to his employer. Correspondingly, there is an implied term that the employer will provide a reasonably suitable working environment and will not behave in a way that is likely to damage the relationship of trust and confidence with his employees. It was thus proper for the court to accept the employer’s application for further and better particulars relating to alleged breaches of the implied term on its part (Robb v. Green, [1895] 2 Q.B. 315, followed; Hivac Ltd. v. Park Royal Scientific Instruments Ltd., [1946] 1 Ch. 169, followed; Sanders v. Parry, [1967] 1 W.L.R. 753, followed).
